Probation files,[ ca. 1941]-[ongoing].

Constitutional Amendment 38 of the 1901 Constitution "transferred from the executive department the power to permit extramural stays of sentence and placed the power in the circuit court and courts of record from whose judgements appeals lie directly to the Courts of Appeals or the Supreme Court" (Holman v. State). Additionally, the interstate compact [Ala. Code 15-22-1 (1975)] allows the state to receive reports concerning Alabama probationers who have relocated in other states. This series may contain any or all of the following documents: order of probation given by court; presentence investigation report; monthly supervision reports; chronological history on probation supervision; correspondence between the probationer, the probation officer, the Board of Pardons and Paroles, and others parties; waiver of extradition; and discharge of probation. Included in this series are records created by the Governor's office prior to 1939.
